Travel Voice & Net, Inc. (“TVN”) provides its services (the “services”) to customer (”you”) subject to this Terms and Conditions (“Terms”), If you do not agree with this Terms, TVN will not accept your application. TVN may, at its sole discretion, modify Terms at any time, and any modifications made will be effective immediately upon posting of the modified Terms.

This document, which is our agreement with you (“Agreement”), set out the Terms and Conditions for providing “clicca mobile /Japan”（”clicca”） under which TVN rents a mobile handset, battery pack, a battery charger(Collectively “Equipment”) to you. ”Terms” must be read in conjunction with the reference guide, any TVN brochure or material describing features, services and / or products you have selected, and the Get to know TVN guide currently in effect, which are incorporated for reference herein.

Additional charges will not apply in the event if you are below the amount of free communication allowance (AFCA). AFCA is including International, Japan domestic or SMS text messages. But you must use the amount of Minimum consumption of Japan domestic calls on each plan in AFCA.

• (1) If your application has been accepted, TVN will charge the amount of your basic plan & shipment charges, to your credit card. Additional charges will apply in the event you exceed AFCA on each plan. We will invoice you monthly. (Invoice will be showing a month behind of your actual usage.)
• (2)Please note that the difference will not be refunded if your actual usage does not exceed the basic plan charge.
• (3)You have an obligation to manage Equipment carefully during rental period. You are liable to pay any charges made by the third party with your rental mobile without regard to your approval or disapproval.
• (4)TVN will take a pre-authorization of ￥45,000 per handset from your credit card to secure the payment. This pre-authorization will temporarily reduce the limit of your credit card by ￥45,000 until expiry of the pre-authorization period. If your card is useful as a debit card, there will be process as a debit transaction automatically and withdrawal from your account. The difference will be credit through your bank after the settlement of your account.

TVN is able to provide you with Services in certain geographic areas covered by our service partners or where roaming arrangements are in place. You can check coverage of your destination in Japan before application. Please note that coverage may be limited in mountain areas, ski slopes and underground areas. Communication may be interrupted by weather, disaster, or building structure even if you are within coverage.

• (1)Authorize TVN to obtain about your credit history and able to make a payment by credit card.
• (2)Agree to be liable for the payment of all charges and other obligations under this agreement.
• (3)Acknowledge that you may not transfer your account to any third party without our prior written approval.

• (1)Please fill in our application form and provide your current and accurate information. TVN will contact you when we need more information or send you a confirmation slip by e-mail or FAX.
• (2)By an Act for the prevention of illegal Mobile phone Use (Japanese law) you will be required to forward certain identifiable information about you issued by public agency (e.g. passport). We are not able to process your application without your identification.
• (3)If your application has been accepted, we will deliver the equipment to your nominated address or hotel. If your address is at hotel, needs to mach with your reservation, otherwise TVN will suspend shipment of equipment until all the facts are in.
• (4)You will return equipment to TVN with pre-paid envelope by nominated return date. There is going to be ￥525 (tax included) per day charges for past due returning fee after your use.

TVN will manage your personal information according to an Act on the Protection of Personal information (Japanese law) and TVN’s own Privacy policy based on Guideline for the telecom service industry. All information regarding you that is retained by us is confidential and may not be disclosed by us to anyone other than you. But TVN may inform your name and rental mobile phone number to your travel agency or organizer only for safety management during your stay in Japan.

• (1)You must notify us immediately if your equipment is lost, stolen or damaged. You are responsible for all charges up to the time you notify us even though the third party was included. You are also responsible for the cost of delivery. We will exchange your equipment without any extra charge if your equipment is unable to use for some reason during rental period except if TVN has reasonable grounds to believe that you have knowingly supplied us with false or misleading information.
• (2)We reserve the right, without notice to you, to suspend or restrict use and access to the network, if you don’ t pay any amount you owe us when due, you give us false or misleading information, you use the Service or equipment fraudulently, unlawfully or improperly or in a way that adversely affects our operation or the use of Services by other customer.
• (3)For any reason whatsoever, TVN’s accumulated compensation for your damages caused by defects of the service shall not exceed the amount of your payment to TVN under this Terms.
• (4)If you would like to cancel our service for any reason before use we may ask you to make a payment for the following.
  * ￥2,100 will apply 3 days before delivery date.
  * ￥1,260 for shipment charges will be added if handset is on its way.

This Terms and conditions will be effective as of January 1st 2007.
